What are the requirements to become a U.S. citizen through naturalization?

To apply for naturalization you must: be at least 18 years old; have been a lawful permanent resident (green card holder) for at least 5 years (3 years if married to a U.S. citizen); have continuous residence in the U.S. for that period; have been physically present in the U.S. for at least half of that time; be able to read, write, and speak basic English; and be a person of good moral character.

Do I need a lawyer to apply for U.S. citizenship?

No. USCIS accepts Form N-400 applications directly from individuals. The form, filing instructions, and fee waiver application are all available free at uscis.gov. Most straightforward applications do not require legal representation. uplaw.ai walks you through every field at no cost.

What is Form N-400 and how do I file it?

Form N-400 is the Application for Naturalization. You submit it online at my.uscis.gov or by mail to the USCIS lockbox facility serving your state. The filing fee is $725 (including biometrics). A fee waiver (Form I-912) is available if your household income is at or below 150% of the federal poverty guidelines. After filing you will receive a biometrics appointment notice within a few weeks.

How long does the naturalization process take?

Processing times vary by USCIS field office and application volume. In recent years average processing times have ranged from 8 to 14 months from filing to the oath ceremony. After filing, you attend a biometrics appointment (fingerprints and photo), then an interview at your local USCIS office where you take the English and civics tests. If approved, you receive an oath ceremony date.

What happens at the naturalization interview?

A USCIS officer reviews your N-400 application, asks questions about your background and eligibility, tests your ability to read and write English sentences, and administers the civics test (10 questions drawn from a list of 100 — you must answer at least 6 correctly). Applicants 65 or older with 20+ years as a permanent resident may take a shorter 20-question civics test.

What is the civics test for naturalization?

The USCIS civics test covers U.S. history and government. USCIS publishes the official list of 100 possible questions and answers at uscis.gov/citizenship/find-study-materials-and-resources. The officer asks up to 10 questions and you must answer 6 correctly. Applicants 65+ with 20+ years as a permanent resident answer only 20 special questions and must get 6 correct from that shorter list.

What is continuous residence and physical presence for naturalization?

Continuous residence means you have not abandoned your U.S. residence. A single trip outside the U.S. of more than 6 months (but less than a year) creates a presumption of abandonment that you must overcome with evidence. Physical presence means you were physically inside the U.S. for at least half of the 5-year (or 3-year) period — trips of any length count against your physical presence calculation.

What is good moral character for naturalization purposes?

USCIS evaluates your conduct during the statutory period (5 or 3 years before filing). Certain acts permanently bar naturalization — murder, aggravated felonies. Other factors that can bar you during the statutory period include: convictions for crimes involving moral turpitude, drug trafficking, multiple criminal convictions with 5+ combined years of imprisonment, lying to obtain immigration benefits, or failing to pay court-ordered child support.

Can I apply for citizenship if I have a criminal record?

It depends on the offense. Minor traffic violations generally do not affect eligibility. Misdemeanors involving moral turpitude or drug offenses during the statutory period can disqualify you. Arrest records without convictions still require disclosure. Be honest on your N-400 — failure to disclose is itself grounds for denial and can result in removal proceedings.

What documents do I need to submit with Form N-400?

Required documents include: a copy of your green card (front and back), passport-style photos, and any documents supporting exceptions or special categories. If applying based on marriage to a U.S. citizen, include your marriage certificate and evidence your spouse has been a citizen for at least 3 years. If you have any criminal history, include certified court dispositions for every arrest or charge.

What happens at the naturalization oath ceremony?

The Oath of Allegiance ceremony is the final step. You renounce allegiance to other countries, swear loyalty to the United States, and receive your Certificate of Naturalization. Ceremonies are held at USCIS offices or federal courthouses — some are large events with hundreds of new citizens. After the ceremony you can apply for a U.S. passport immediately.

Can military members apply for naturalization faster?

Yes. U.S. military members who have served honorably for at least one year may apply for naturalization without meeting the standard continuous residence or physical presence requirements using Form N-400 with the military exception. Service members serving in a hostile fire zone may naturalize immediately upon filing with no prior green card required under Section 329 of the Immigration and Nationality Act.
