What is the difference between legal separation and divorce in England and Wales?
Legal separation means you live apart and can have financial arrangements formalised by the court, but you remain legally married. Divorce ends the marriage entirely. Legal separation is useful for couples who cannot or do not wish to divorce — for example for religious reasons, because they have been married less than one year, or because they want to retain certain spousal benefits.
What is judicial separation and how do I apply?
Judicial separation is the formal court route to legal separation in England and Wales. You apply using Form D8 (the same form used for divorce) at the family court, selecting judicial separation rather than divorce. The court fee is currently £593. You do not need to have been married for a minimum period before applying for judicial separation.
What does judicial separation cover and what can the court order?
A judicial separation order relieves you of the duty to cohabit but does not end the marriage. Within the judicial separation proceedings the court can make the same financial orders as in divorce — property adjustment orders, lump sum orders, maintenance orders, and pension sharing orders. It does not however affect your right to inherit from each other on intestacy.
What is a separation agreement and is it legally binding?
A separation agreement is a written contract between spouses that records how they will divide assets, deal with the family home, arrange maintenance, and handle children. It does not require a court application and there is no fee. A separation agreement is not automatically legally binding in England and Wales but is treated as a material consideration by the court and is very likely to be upheld if it was freely negotiated with full financial disclosure on both sides.

Can I separate finances through a separation agreement without going to court?
Yes. A separation agreement can cover how you will divide the matrimonial home (including whether one party buys out the other), savings and investments, pensions, and any maintenance payments. You should each have independent legal advice before signing, and both parties must make full financial disclosure. This approach is faster and less expensive than court proceedings.
Can a financial order made within judicial separation proceedings be converted to a divorce financial order?
Yes. If you later divorce the financial orders made within judicial separation proceedings remain in force and can be transferred into the divorce financial settlement. This gives couples flexibility — you can deal with finances through judicial separation and then apply for a no-fault divorce when you are ready.
How does the no-fault divorce system introduced in 2022 affect legal separation?
Since 6 April 2022 couples in England and Wales can apply for a no-fault divorce after one year of marriage without needing to blame either party. This has reduced the incentive for judicial separation as a stepping stone to divorce. However, judicial separation remains useful for those who want financial court orders but cannot or do not want to divorce.

Does a separation agreement affect my pension rights?
A separation agreement can include provision for pensions but it cannot in itself transfer pension rights — that requires a pension sharing order from the court. A separation agreement may commit both parties to seeking a consent order for pension sharing when they later divorce, but you cannot enforce a pension split without a court order.
Do I need a solicitor to make a separation agreement in England and Wales?
You do not legally need a solicitor. However, courts are more likely to uphold a separation agreement where both parties received independent legal advice before signing. Without legal advice there is a greater risk the agreement could be challenged later on grounds of undue influence, incomplete disclosure, or unfairness.
